Welcome to Rift Surge ("Game"), operated by Pixelized Echo LLC ("Pixelized Echo," "Company," "we," "our," or "us").

By downloading, installing, accessing, or using Rift Surge, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Game.

By using Rift Surge, you confirm that:

• You have read and understood these Terms. 
• You agree to comply with these Terms. 
• You are legally capable of entering into a binding agreement. 
• If you are under the age of majority in your jurisdiction, you have permission from a parent or legal guardian. 

Subject to these Terms, Pixelized Echo grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Rift Surge. 
• Access and use the Game for personal, non-commercial entertainment purposes. 

You may not:

• Sell, rent, sublicense, lease, or distribute the Game. 
• Reverse engineer, decompile, or modify the Game except where expressly permitted by law. 
• Use cheats, bots, automation tools, exploits, or unauthorized software. 
• Interfere with servers or game systems. 
• Attempt unauthorized access to accounts, systems, or data. 

Certain features may require an account.

You are responsible for:

• Maintaining account security. 
• Keeping login information confidential. 
• All activity occurring under your account. 

You must notify us immediately if you suspect unauthorized access.

Rift Surge may include:

• Online multiplayer features 
• Leaderboards 
• Seasonal events 
• Competitions 
• Cloud saves 
• Community features 

Online services may be modified, suspended, or discontinued at any time without prior notice.

We do not guarantee uninterrupted availability.

Rift Surge may offer:

• Virtual currency 
• Cosmetic items 
• Event passes 
• Premium content 
• Subscription services 

Purchases are processed through:

• Apple App Store 
• Google Play Store 

All purchases are subject to the terms and policies of the applicable platform.

The Game may include:

• Coins 
• Rift Crystals 
• Surfboards 
• Characters 
• Skins 
• Cosmetic rewards 

Virtual items:

• Have no real-world monetary value. 
• Cannot be exchanged for cash. 
• Are licensed, not sold. 
• May be modified, removed, or discontinued. 

Pixelized Echo reserves the right to manage, regulate, modify, or eliminate virtual items at any time.

If subscriptions are offered:

• Subscriptions automatically renew unless canceled. 
• Billing is handled by Apple or Google. 
• Subscription benefits may change over time. 
• Cancellation policies are governed by the Subscription Cancellation Policy. 

Users are responsible for managing subscriptions through their platform account settings.

Rift Surge may offer:

• Seasonal competitions 
• Distance challenges 
• Monthly rewards 
• Leaderboards 
• Promotional events 

Pixelized Echo reserves the right to:

• Verify eligibility. 
• Investigate suspicious activity. 
• Disqualify participants engaging in cheating, exploitation, fraud, or misconduct. 
• Modify or cancel events when necessary. 

All decisions regarding competitions are final.

You agree not to:

• Cheat or exploit bugs. 
• Use unauthorized software. 
• Harass other players. 
• Upload offensive, unlawful, or harmful content. 
• Impersonate other users or Pixelized Echo representatives. 
• Attempt to disrupt the Game. 

Violations may result in:

• Suspension 
• Leaderboard removal 
• Reward forfeiture 
• Permanent account termination 

If the Game allows usernames, profiles, comments, submissions, or other content:

You retain ownership of your content.

However, you grant Pixelized Echo a worldwide, royalty-free, non-exclusive license to:

• Display 
• Reproduce 
• Distribute 
• Promote 

such content in connection with the Game.

You represent that your content does not violate any law or third-party rights.

Rift Surge and all related materials, including but not limited to:

• Logos 
• Artwork 
• Characters 
• Surfboards 
• Animations 
• Music 
• Storylines 
• Designs 
• Software 

are owned by Pixelized Echo LLC or its licensors and are protected by applicable intellectual property laws.

No rights are granted except as expressly stated in these Terms.

Pixelized Echo may:

• Release updates 
• Modify gameplay 
• Rebalance content 
• Add or remove features 
• Introduce new content 

Continued use of the Game after updates constitutes acceptance of those changes.

We may suspend or terminate access if:

• These Terms are violated. 
• Fraudulent activity is detected. 
• Unauthorized software is used. 
• Activity threatens the security or integrity of the Game. 

We reserve the right to terminate accounts at our discretion where permitted by law.

Use of Rift Surge is also governed by the Rift Surge Privacy Policy.

The Privacy Policy explains how information is collected, used, and protected.

The Game may integrate with:

• Apple Game Center 
• Google Play Games 
• Apple App Store 
• Google Play Store 
• Analytics providers 
• Advertising providers 

Your use of those services may also be governed by their own terms and privacy policies.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

RIFT SURGE IS PROVIDED "AS IS" AND "AS AVAILABLE."

PIXELIZED ECHO DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY 
• FITNESS FOR A PARTICULAR PURPOSE 
• NON-INFRINGEMENT 
• AVAILABILITY 
• ACCURACY 
• SECURITY 

We do not guarantee uninterrupted or error-free operation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PIXELIZED ECHO LLC SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES 
• INCIDENTAL DAMAGES 
• CONSEQUENTIAL DAMAGES 
• LOST PROFITS 
• LOST DATA 
• BUSINESS INTERRUPTION 

ARISING FROM USE OF OR INABILITY TO USE THE GAME.

Where liability cannot be excluded, liability shall be limited to the amount paid by the user to Pixelized Echo during the preceding twelve (12) months.

You agree to indemnify and hold harmless Pixelized Echo LLC and its affiliates, officers, employees, contractors, and partners from claims, liabilities, damages, losses, and expenses arising from:

• Violation of these Terms 
• Misuse of the Game 
• Violation of applicable laws 
• Infringement of third-party rights 

Rift Surge may not be available in all countries or regions.

Access may be restricted where prohibited by law.

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to conflict-of-law principles.

Nothing in these Terms limits rights that cannot legally be waived under applicable law.

If you downloaded Rift Surge through the Apple App Store:

• These Terms are between you and Pixelized Echo LLC, not Apple. 
• Apple has no obligation to provide maintenance or support services. 
• Apple is not responsible for claims relating to the Game. 
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. 

Users must comply with all applicable App Store terms.

If you downloaded Rift Surge through Google Play:

• Your use of the Game must comply with Google Play Terms of Service. 
• Google is not responsible for support or maintenance of the Game. 
• Google is not liable for claims arising from use of the Game. 

Pixelized Echo may update these Terms at any time.

Updated Terms will be posted within the Game or on the official website.

Continued use after changes become effective constitutes acceptance of the revised Terms.
